Privacy Policy

This Privacy Policy applies to information collected by SENSHAVE (“SENSHAVE,” “we,” “our,” or “us”) in connection with the products and services that SENSHAVE offers. This includes information collected online through our websites, branded pages on third-party platforms (i.e., social networking services), our mobile applications, and through our direct marketing campaigns or other online communications, as well as offline through SENSHAVE employees, events, and mobile messaging services (collectively, the “SENSHAVE Services”).

This Privacy Policy explains how information collected in connection with the delivery of the SENSHAVE Services may be used and disclosed, how we safeguard it, and how you may access and control its use in connection with our marketing communications and business activities. By using the SENSHAVE Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree, please do not use the SENSHAVE Services.

This Privacy Policy is hereby incorporated into the terms and conditions of use of the SENSHAVE Services. By using the SENSHAVE Services, you also agree to the Terms of Use.

In addition to this Privacy Policy, there may be specific campaigns or promotions that are governed by additional privacy terms or policies. We encourage you to read these additional terms or policies before participating in any such campaigns or promotions, as you will be required to comply with them if you participate. Any additional privacy terms or policies will be made prominently available to you.

When information identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you or your household, we refer to it as “Personal Information” in this Privacy Policy.

NOTICE AT COLLECTION OF PERSONAL INFORMATION

We collect the categories of Personal Information (as defined in the California Consumer Privacy Act (“CCPA”)) listed in the table below.

We collect identifiers, including your name, phone number, postal address, email address, IP address, username, unique identifiers, or other similar identifiers. Sold or Shared: YES.

We collect professional or employment-related information, including information relating to income level. Sold or Shared: NO.

We may generate inferences from the Personal Information described above to create a personalized profile in order to identify goods and services that may be of interest to you. Sold or Shared: NO.

We may collect sensitive personal information, including account log-in information in combination with the password allowing access to your account, or information relating to racial or ethnic origin. Sold or Shared: NO.

We use the categories of Personal Information listed above for the following business and commercial purposes: to provide you with the SENSHAVE Services; to process payments and fulfill orders; to create, maintain, and customize your account; to communicate with you, including through bots, such as responding to your inquiries and requests for feedback; to review, operate, and maintain the functionality of our Services; to conduct analysis and to develop, improve, or enhance our products and Services; to monitor, protect, and maintain the security and integrity of our Services and our business, including protecting against and preventing fraud, unauthorized transactions, claims, and other liabilities; to comply with applicable laws and regulations and to respond to lawful requests and communications from law enforcement and other government authorities; to carry out sales, mergers, acquisitions, or other business transactions in which Personal Information held by us is among the assets transferred or is otherwise relevant to the evaluation, negotiation, or completion of the transaction; to protect the rights, privacy, safety, and property of SENSHAVE and others; to fulfill any other purpose for which you provide your Personal Information or as otherwise disclosed to you at the time of collection; to provide you with customized content or targeted offers; and to send you information, newsletters, and marketing or promotional materials from us and, where permitted by law, from or on behalf of our marketing partners and affiliates.

As noted above, we may “sell” or “share” certain categories of Personal Information, as those terms are defined under the California Consumer Privacy Act (“CCPA”). You may exercise your right to opt out of such sale or sharing by completing and submitting the opt-out form made available by SENSHAVE. Alternatively, where available, you may choose to enable an online preference signal that automatically communicates your opt-out choices, such as the Global Privacy Control (“GPC”). When such signals are detected, SENSHAVE will process them as a valid request to opt out.

We retain each category of Personal Information that we collect for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to comply with legal, regulatory, accounting, or reporting requirements.

Personal Information You Provide When You Interact with SENSHAVE

When you engage with us, we may ask you to provide certain Personal Information to obtain or use the SENSHAVE Services. For example, we may request Personal Information when you register to create an account; sign up for a membership or subscription; use certain features; access, upload, or download content; enter sweepstakes or other promotions administered by us (or on our behalf); register or participate in a competition administered by us (or on our behalf); request customer support; report an adverse event; or otherwise communicate with us.

Personal Information You Provide When You Participate in an Online Survey or Other Research

We collect Personal Information you provide in connection with your participation in an online survey or research panel administered by us (or on our behalf). This may include information about your shopping habits, lifestyle preferences, interests and hobbies, health, physical or behavioral characteristics, or other demographic information, as well as photos, videos, and other user-generated content.

Personal Information You Provide When You Make a Purchase

If you purchase products or services from us, you will be required to provide a credit or debit card number and related financial information (such as CVV, expiration date, and billing address), or other payment information (such as via PayPal or Apple Pay), depending on the payment method you choose.

Personal Information You Provide about a Third Party

You may choose to provide us with another person’s information (such as name, email address, physical address, or phone number) so that we may recommend or send products or services to such person, or facilitate your communication with others.

Personal Information Collected Automatically

Whenever you visit or interact with the SENSHAVE Services online, SENSHAVE, as well as third-party advertisers and service providers, may use technologies that automatically or passively collect information about your online activity, as described below.

Usage Information

We and our partners and service providers may use cookies, web beacons, pixel tags, mobile analytics software, log files, or similar technologies to collect information about your interactions with the SENSHAVE Services. This information helps us analyze usage, improve our Services, and provide more relevant content and advertising.

The information collected may include browser type, mobile device manufacturer, mobile carrier, phone number, operating system, activations, content, products or services accessed or purchased, referring and exit pages, device activity and configurations, and email client. We may also collect information about your use of the SENSHAVE Services, including date and time of visits, pages viewed, time spent, return frequency, keystrokes, mouse movements, form entries, recordings of chat sessions, use of AI-supported tools, and other engagement metrics.

Additionally, if you receive an email from us, we may collect information regarding your interaction with that email, such as whether it was opened, forwarded, or clicked.

Device Information

We may automatically collect your IP address or other unique device identifiers for the device you use to access the SENSHAVE Services, as well as device model and mobile network information. This information is used to operate the Services, diagnose server issues, analyze trends, track activity, gather demographic information in aggregate, and deliver targeted advertising across devices.

Geolocation Information

We may collect approximate location information from your device when you access or use the SENSHAVE Services. If you enable Bluetooth, Wi-Fi, or other location-based features on our mobile applications, we may also collect and use that geolocation data.

Third Party Service Providers

We may engage third-party service providers to support the SENSHAVE Services. These providers may use cookies, web beacons, pixel tags, log files, or similar technologies to collect and store Personal Information on our behalf.

Third Party Services and Technologies

We may use third-party services such as Google Analytics (including Google Signals), Adobe Marketing Cloud services, and Meta Conversations API, Pixel, and Custom Audiences to analyze usage of the SENSHAVE Services and deliver targeted advertising on our Services, third-party platforms, and across the Internet. For these purposes, we may share certain identifying information or interaction data with these third parties. These third parties may combine this data with information collected from other sources, and we may not have access to all data they collect.

Personal Information Received from Third Parties

We may receive Personal Information about you from trusted third-party sources, including public databases, data aggregators or brokers, partners, analytics vendors, advertising networks, and search engine providers. This information may include demographic data, media consumption, purchase history, shopping habits, loyalty program information, or lifestyle preferences.

You may also choose to link your social media accounts (such as Facebook) to the SENSHAVE Services. When you do so, we may receive information from those platforms based on your privacy settings, including your name, username, contact information, location, interests, and publicly available data.

We use information received from third parties to maintain data accuracy, personalize your experience, target communications, measure advertising performance, conduct internal analysis, and fulfill other business or commercial purposes.

Combination of Personal Information

We may combine Personal Information collected from you directly, automatically through the SENSHAVE Services, offline, across devices, and from third-party sources. Combined Personal Information is used, disclosed, and protected in accordance with this Privacy Policy.

2.HOW WE USE THE PERSONAL INFORMATION COLLECTED

We may use Personal Information for a variety of business and commercial purposes, including:

For Customer Service and Transactional Purposes, such as to:

provide you with the SENSHAVE Services and access to certain features (where applicable);
respond to your questions or requests and provide customer service;
manage your account and registration;
troubleshoot issues, bugs, or defects related to your account or activities or our products or services;
validate, confirm, verify, deliver, and track your order (including arranging shipping, handling returns and refunds, and contacting you about your order, including by telephone), and send you related information, coupons, products, or samples;
verify your identity or communicate with you about your activities with respect to the SENSHAVE Services;
process your payments and fulfill your orders;
contact you regarding your use of the SENSHAVE Services and, at our discretion, changes to any SENSHAVE policy;
develop new products or services and enhance existing products and services; and
protect the security and integrity of the SENSHAVE Services and our business, including protecting against and preventing fraud, unauthorized transactions, claims, and other liabilities, and managing risk exposure, such as identifying potential hackers or other unauthorized users.

For Commercial Purposes, such as to:

conduct market research and analyze the effectiveness of our promotions, competition, and SENSHAVE Services analytics and operations;
provide you with customized content, advertisements, offers, and promotions offered by SENSHAVE or on behalf of our partners and affiliates on the SENSHAVE Services and/or across third-party services;
link or combine Personal Information we receive from other sources to better understand your needs, deliver targeted advertising to you across your computers or other devices, and improve our services; and
communicate with you for SENSHAVE marketing and promotional purposes (including news, updates, and other information we believe may be of interest to you) via email, notifications, or other messages, consistent with any permissions you have provided.

We may also use Personal Information you provide to us for other purposes that are disclosed to you at the time you provide such information or otherwise with your consent.

Please note that we may de-identify or aggregate information so that it no longer constitutes “Personal Information,” and we may use such information for analytics purposes or other purposes consistent with those described in this Privacy Policy.

3.DISCLOSURE OF PERSONAL INFORMATION

We may disclose each of the categories of Personal Information we collect from and about you to the following categories of recipients:

With Our Affiliates. We may share your Personal Information with our subsidiaries and affiliated companies for internal purposes, primarily for business and operational purposes, and for marketing purposes.

Third Party Service Providers. We may share your Personal Information with third-party service providers that provide business, professional, or technical services to us. This includes, but is not limited to, hosting or operating the SENSHAVE Services; processing payments; analyzing data; providing customer service; providing postal or delivery services; and administering promotions.

Business Partners. We may disclose your Personal Information to other companies with whom we partner to provide services or other offerings to you and to carry out related activities. For example, we may disclose your Personal Information to a third party that co-sponsors a sweepstakes or other promotion (“Promotion”).

Research Partners. We may disclose your Personal Information to our research partners, including those that administer surveys or conduct research projects in partnership with us or on our behalf.

Analytics Partners. We may disclose your Personal Information to partners that assist us in performing analytics and in measuring the effectiveness of the content of the SENSHAVE Services and our marketing and advertising efforts.

Marketing and Advertising Partners. We may disclose your Personal Information to third parties for marketing and advertising purposes, including social media platforms, third-party advertising networks, and other parties that assist us in serving and optimizing advertisements.

Competent Governmental, Regulatory, and Public Authorities. SENSHAVE may disclose or transfer your Personal Information to third parties to comply with legal obligations; when we believe in good faith that the law requires it; at the request of governmental authorities conducting an investigation; to verify or enforce our Terms of Use or other applicable policies; to detect and protect against fraud or technical or security vulnerabilities; to respond to an emergency; or otherwise to protect the rights, property, safety, or security of SENSHAVE, users of the SENSHAVE Services, third parties, or the public.

Relevant Third Parties as Part of a Corporate Transaction. In the event that another entity acquires SENSHAVE or all or substantially all of our assets, or assets related to the SENSHAVE Services, your Personal Information may be disclosed to such entity as part of the due diligence process and transferred as one of the acquired assets. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such Personal Information may be considered an asset of SENSHAVE and may be sold or transferred to third parties. Personal Information may also be disclosed for due diligence purposes in connection with any proposed transaction of the types described above.

Other Third Parties. Your Personal Information may also be shared with sponsors, partners, advertisers, advertising networks, advertising servers, analytics companies, or other third parties in connection with marketing, promotional, or other offers, as well as product-related information. Your Personal Information may also be shared with third parties identified at the time you provide your Personal Information or otherwise with your consent.

We may disclose your Personal Information for other reasons that we will describe at the time of information collection or prior to disclosing your information.

Depending on your U.S. state of residency, certain disclosures described above may constitute a “sale” or “sharing” of Personal Information under applicable law. Information on how to exercise your legal rights with respect to such sales or sharing is provided in the “Your Privacy Rights” section below.

Please note that we may also share aggregated or anonymized (de-identified) information with third parties for marketing, analytics, or other purposes. Such information does not contain Personal Information.

4. YOUR PRIVACY RIGHTS

Depending on your U.S. state of residence, you may have certain rights in relation to your Personal Information, as described in this section.

We are currently accepting requests from residents of California, Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Tennessee, Utah, Virginia, or any other U.S. state with an applicable privacy law.

Right to Know and Access

You may request that SENSHAVE confirm whether we are processing your Personal Information and, if so, obtain details regarding such processing.

You have the right to know what Personal Information we have collected about you, including:

the categories of sources from which the Personal Information is collected;

the business or commercial purposes for collecting, selling, or sharing Personal Information;

the categories of third parties to whom we disclose Personal Information;

the categories of Personal Information disclosed to third parties; and

the specific pieces of Personal Information we have collected about you.

Please note that we may not be required to respond to requests to know or access specific pieces of Personal Information more than twice in any 12-month period.

You may also request that we provide your Personal Information in a portable and, to the extent technically feasible, readily usable format.

You may have the right to request a list of the categories of third parties to whom we have disclosed your Personal Information.

You may have the right to request a list of the specific third parties with whom we have sold or shared your Personal Information.

Right to Delete

Subject to certain exceptions, you may request that we delete your Personal Information. We may retain certain Personal Information where necessary, such as to complete transactions, detect and prevent fraud or illegal activity, exercise our rights, comply with legal obligations, or for internal business purposes.

Right to Correct

Subject to certain exceptions and appropriate verification, you may request that we correct inaccuracies in your Personal Information. SENSHAVE will use commercially reasonable efforts to honor such requests.

Right to Opt-Out of Sale or Sharing

You have the right to opt out of the “sale” or “sharing” of your Personal Information, or the use of your Personal Information for “targeted advertising,” as those terms are defined under applicable state privacy laws.

Right to Revoke Consent

Where we rely on your consent to process Personal Information, you may revoke that consent at any time, where applicable.

Right to Limit Certain Processing Activities

Where applicable, you have the right not to be subject to decisions based solely on automated processing, including profiling, that produce legal or similarly significant effects.

If you exercise any of the rights described above, SENSHAVE will not discriminate against you, including by denying goods or services, charging different prices, or providing a different level or quality of services.

How to Submit a Request

To exercise an applicable privacy right, you may submit a request through SENSHAVE’s privacy request mechanism made available on our website, or contact us using the information below:

We may request additional information to verify your identity before responding to access, deletion, correction, or portability requests. SENSHAVE will confirm receipt of your request within ten (10) business days and will respond within forty-five (45) calendar days following verification, unless an extension is required, in which case we will notify you.

To exercise your right to opt out of the sale or sharing of Personal Information or targeted advertising, you may use the “Do Not Sell or Share My Personal Information” link available on our website footer or contact us at romanticearth@romanticearth.com. We will use commercially reasonable efforts to comply with such requests within fifteen (15) business days.

Submitting a privacy request does not require you to create an account. You have the right to appeal a denial of your privacy request by contacting us as described in this Privacy Policy.

Global Privacy Control (GPC)

Where available, you may use browser-based opt-out preference signals that comply with applicable law, such as the Global Privacy Control (GPC). When detected, SENSHAVE will treat such signals as a valid request to opt out of the sale or sharing of Personal Information associated with that browser and any related consumer profile. If you use multiple browsers or devices, you must enable the signal on each.

We respect your privacy choices and do not discriminate in response to the exercise of privacy rights.

Agent Requests

You may authorize an individual or entity to submit a privacy request on your behalf (an “authorized agent”). Authorized agents must demonstrate authorization to act on your behalf or provide proof of power of attorney where applicable. SENSHAVE may request confirmation directly from you or additional information to verify the agent’s authority or identity.

Authorized agents may use Personal Information solely to fulfill the consumer’s request, for verification, or for fraud-prevention purposes.

The chart below (where provided) describes the categories of Personal Information SENSHAVE has collected from California residents during the preceding twelve (12) months, the sources of that information, the categories of third parties to whom the information was disclosed for a business purpose, and the categories of third parties to whom the information was sold or shared, as defined under the California Consumer Privacy Act (“CCPA”).
